The petitioners seek quash of the charge sheet filed by first respondent, in C.C.No.3016 of 2014, on the file of the 18th Metropolitan Magistrate Court, Saidapet, Chennai.

Heard learned counsel for petitioners and learned Government Advocate [Crl.side] for first respondent.

The notarized copy of the terms of the compromise/consent entered into between first petitioner and second respondent/de facto complainant, in M.J.Petition No.2263 of 2013, on the file on the Family Court, Bandra, Mumbai, dated 13.04.2017 is produced. The same informs the terms of the settlement between the husband and wife and that proceedings in C.C.No.3016 of 2014 on the file of 18th Metropolitan Magistrate Court, Saidapet, Chennai, may be quashed in keeping therewith. 4.

The Criminal Original Petition is allowed. The proceedings in C.C.No.3016 of 2014, on the file of 18th Metropolitan Magistrate Court, Saidapet, Chennai, are quashed. Notarized copy of the following (1) Demand Draft bearing No.402012 dated 10.04.2017 drawn on Citi Bank, Bombay, for Rs.10,00,000/- in favour of Khushboo Wase (2)Consent terms dated 13.04.2017 signed by both

parties as also their respective counsel filed before Family Court, Bandra, Mumbai, in proceedings in M.J.Petition No.2263 of 2013 and (3) Receipt given by Khusboo Wase affirming receipt of demand draft in a sum of Rs.10,00,000/- shall form part of the record. Consequently, connected Miscellaneous Petition is closed.
