in C.S.No.165 of 2019 P.T.ASHA, J., Though the application in A.No.1449 of 2020 is filed seeking to implead the applicants therein as a party to the proceedings in C.S.No.165 of 2019, the learned counsel for the applicants therein on instructions would submit that his only intent of being impleaded in the suit is to ensure that the premium for the Group Health Insurance taken out for the benefit of the members of the defendant society is regularised by paying the same and bringing it up to date.

2. Mr.P.H.Arvindh Pandian, learned Additional Advocate General, on instructions would submit that the Government has no objections to permit Honourable Mr. Justice. M.Jaichandran, a retired Judge of this Court who has been appointed as an Election 1/4

Officer for the 1st defendant Society to operate the Bank Account of the Tamil Nadu Film Producer's Welfare Trust as a one-time arrangement for paying the premium in respect of the scheme which has been appended at page no. 10 of the typed set of papers filed along with the application in A.No.1449 of 2020. However, he would submit that this arrangement can only be a one time arrangement and should be without prejudice to the contention of the Government that the transfer of funds by the 1st defendant Society to the Trust is illegal and which has to be argued in the suit. The said undertaking is recorded and the following order is passed.

3. Honourable Mr. Justice. M.Jaichandran, a retired Judge of this Court who is already appointed as the Election Officer, shall operate the Bank Account of the Tamil Nadu Film Producer's Welfare Trust to pay the premium to M/s. Star Health and Allied Insurance Company Limited for the group health insurance as indicated in page no.10 of the typed set of papers filed along with 2/4

the application in A.No.1449 of 2020.

4. It is made clear that this order is a one time arrangement and without prejudice to the contention of the Government as raised in the suit as regards the transfer of funds by the Society to the Trust.

5. Considering the above order, there is no necessity for the applicants to be impleaded in the above suit. The application is therefore disposed of on the above lines.
