PRAYER :- Civil Revision Petition is filed under Article 227 of the Constitution of India, pleased to set aside the fair and decreetal order of the Family Court at Erode dated 07.07.2023 in I.A.No.1 of 2019 in F.C.O.P.No.122 of 2018.

ORDER

Challenging the grant of a monthly maintenance of Rs.5000/- to the wife, the petitioner husband is before this Court. 1/5

2.The main ground on which this paltry amount of maintenance has been challenged on the ground that the respondent wife has taken away the fixed deposit that stood in the name of the daughter and therefore she is not entitled to any compensation.

3.In this regard, the finding of the learned Family Judge, Erode, would clarify the position. The learned Judge has observed that on 13.02.2016, the fixed deposit standing in the name of the minor daughter had been closed and the amount was transferred to the savings bank account of the respondent wife, as evidenced by Ex.C1. It is seen that thereafter, the respondent wife has withdrawn a sum of Rs.5,50,000/- and the petitioner husband withdrawn a sum of Rs.4,50,000/- and together they have made a deposit in the name of the minor daughter. Therefore, the contention of the petitioner that the entire sum of Rs.10,00,000/-has been taken away by the respondent wife is a false statement. Therefore, the Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
