ORDER : The Court Made the following order :- The petitioner herein, who was arrested on 29.03.2022 for the alleged offence under Sections 273, 328 of IPC read with Section 24

(1) of Cigarette and Other Tobacco Products Act 2003, in Crime No.123 of 2022, seeks bail.

2. The petitioner herein, who was arrested on 29.03.2022 for the alleged possession of banned Tobacco products in his shop, is before this Court seeking bail. The F.I.R. indicates that from the shop of the petitioner, 195 packets of Chaap Tobacco each 20 grams, 1020 packets of Vimal Pan Masala each 2.9 grams, 48 packets of Cool Lip Fitter Tobacco each 6 grams, 102 packets of Cool Lip Tobacco each 6 grams and 204 packets of Chaini Tobacco each 5.75 grams were found in his possession.

3. The learned counsel for the petitioner states that the petitioner herein is 73 years old man and he is no way connected with the alleged contraband seized.

However considering the quantity found in possession of the petitioner and the submission of the learned Additional Public Prosecutor that the source of the contraband is yet to be traced, this Criminal Original Petition for bail is dismissed. -sd/- 28/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
