Seeking a direction to call for the records in Crime No.1204 of 2015 pending on the file of the 1st respondent and quash the same, this petition has been filed.

On the complaint lodged by K.Prasad (third respondent/defacto complainant), the second respondent police have registered a case in Crime No.1204 of 2015 for the offences https://hcservices.ecourts.gov.in/hcservices/

under Sections 420 and 506(i) IPC r/w Sections 3(1)(x) of the SC/ST (Prevention of Atrocities) Act, against Venkateswaran (accused), challenging which, Venkateswaran is before this Court on the ground that he has arrived at an amicable settlement with the defacto complainant.

Today, Mr.S.Balamurugan, Special Sub Inspector of Police is present. Venkateswaran(accused) and K.Prasad(de facto complainant) are also present and they are identified by the Special Sub Inspector of Police. They have filed a compromise memo, wherein both the parties have agreed to have the case quashed.

K.Prasad (de facto complainant) when questioned, has stated that he has come on his own volition and that he has no objection in the prosecution being quashed, so that there can be amiable relationship between them.

Recording the same, this criminal original petition is allowed and the proceedings in Cr.No.1204 of 2015 pending on the file of the 1st respondent is quashed. Consequently, connected Miscellaneous Petition is also closed.
