Heard learned counsel for the appellant through video conferencing due to the Covid-19 pandemic.

2. Mr.V.M.Venkatramana, learned counsel appearing for the appellant sought permission to withdraw the civil miscellaneous appeal.

3. Recording his statement, the civil miscellaneous appeal is dismissed as withdrawn. Consequently, C.M.P.No.9397 of 2019 is also dismissed. The trial Court is directed to proceed with the trial and dispose of the matter on merits and in accordance with law expeditiously. No costs.
