ORDER : The Court Made the following order :- The petitioner, who was arrested on 22.03.2021 for the alleged offence under Sections 294(b), 376(i), 417 & 506(i) of IPC @ 294(b), 376(i), 417, 506(i), 306 of IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act in Crime No.124 of 2021 on the file of the respondent police, seeks bail.

2. According to the prosecution, the petitioner and the deceased Nirmala were in love with each other and the petitioner promised to marry the defacto complainant and had physical relationship with her. Later he refused to marry her. Due to which, she committed suicide. Based on the complaint lodged by the defacto complainant, the law enforcing agency registered a case against the petitioners and other accused.

3. The learned counsel for the petitioner submitted that the petitioner has nothing to do with the said allegation and a false case has been foisted on the petitioner only on suspicious. The petitioner is in the judicial custody from 22.03.2021 and hence, the learned counsel prays to grant bail.

4. The learned Public Prosecutor would submit that the petitioner and the deceased Nirmala were in love with each other and the petitioner promised to marry the deceased and had physical https://hcservices.ecourts.gov.in/hcservices/

relationship with her. Due to which, she got pregnant. When the petitioner refused to marry the deceased, she committed suicide and the investigation is pending. Hence, he opposed to grant bail to the petitioner

5. Considering the gravity of the accusation against the petitioner and the case is at initial stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
