Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the second respondent to consider the representation of the petitioner dated 02.02.2023 and forbear the respondents from converting or changing the usage of about 160.1 Acres of land earmaked as Open Space Reservation in the SIPCOT Orgadam Industrial Corridor, Oragadam, Kancheepuram District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This Public Interest Litigation (PIL) was filed on the allegation that, while constructing road, a part of the Open Space Reservation (OSR) land has been encroached upon.

3. The allegation made in the petition turns out to be incorrect, in view of what has been stated in the affidavit-in-reply, which has been filed by the second respondent, wherein it has been clearly stated that under the original plan of the area which contained OSR also to the extent of 161.55 acres, which included OSR area also, the same has been kept reserved and undisturbed.

4. Therefore, in that view of the fact, we have no reason to disbelieve what has been stated in the affidavit-in-reply filed by the second respondent, particularly, when there is nothing coming forward from the petitioner by way of rejoinder.
