ORDER
The petitioners filed this writ petition challenging the impugned letter sent by the first respondent questioning their construction of
buildings in their private lands on the reason of the proposal to erect a tower occupying about 2690 sq.ft. in the petitioners land without issuing any show cause notice and without acquiring the lands under the guise of Telegraph Act 1885 as if the said Act permits to occupy and make construction and use it permanently for them. The grounds of challenge, inter alia, is that no persons private lands can be trespassed and used depriving the said persons from using it without resorting to land acquisition in accordance with Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
2. The learned counsel for the petitioner insisted this Court that grant of ex-parte interim order. If injunction is granted in this case, it will amount virtually allowing the prayer made in the writ petition. Therefore, injunction petition in WMP.No.12545 of 2026 is not entertained and the same is dismissed. The petitioner's grievance for claiming compensation or damages will be considered in the main writ petition. 27-03-2026 RLI
