Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned revised seniority list made in Letter No. 075008/794/ G.55/G.552/2012-2 dated 12.10.2013 and the selection order made in Memo No.057043/706/G15/G.151/2013-2 dated 21.12.2013, the consequential impugned call letter for promotion to the post of Junior Engineer (Mechanical) I Grade made in Letter No.047018/249/Adm.Branch/G4/S/2014-4 dated 04.08.2014 passed by the 2nd respondent and quash the same as illegal and without jurisdiction and consequently, direct the respondents 1 and 2 to promote the petitioner to the post of Junior Engineer (Mechanical) II Grade from the date on which the 3rd respondent was selected to the post of Junior Engineer (Mechanical) II Grade with all attendant benefits. O R D E R

In the light of the order dated 20.11.2012 passed by this Court in W.P.No.20481 of 2012, the respondent TANGEDCO was granted liberty to finalise the seniority list of Junior Engineer (Mechanical) Grade-II from the

year 2002 onwards, after publishing the same, following due procedure, and strictly adhering to the 3:1 ratio prescribed for selection.

2. Pursuant thereto, the respondent TANGEDCO published the seniority list of Junior Engineer (Mechanical) Grade-II through internal selection during the year 2008. In the revised selection/seniority list published in the year 2009, the name of the petitioner was placed at Serial No.62 under the Backward Community category.

The grievance of the petitioner is that the private respondents herein, who are juniors and were appointed at a later point of time as Technical Assistants, were placed below the petitioner in the earlier seniority list. According to the petitioner, in the revised seniority list, the said private respondents were placed above the petitioner.

4. The official respondents, in their counter affidavit, have stated that the private respondents belong to the Most Backward Community and that, by applying the rule of community rotation, their names were rightly placed above the petitioner in the revised seniority list. It is contended that such placement is strictly in accordance with the Board Proceedings dated 10.05.2006.

5. It is further stated that out of 60 employees, 43 were found eligible under both the old and revised lists, while 17 new employees were included in place of 17 employees who were found ineligible upon revision. Out of those 17

ineligible employees, three were subsequently found eligible, and they are the private respondents herein, all belonging to the Most Backward Community.

6. Though the petitioner was appointed prior to the private respondents, considering the community rotation applicable to candidates belonging to the Most Backward Community, the placement of the private respondents above the petitioner is in conformity with the relevant Board Resolution.

7. Therefore, this Court finds that there is no illegality in the revised selection/seniority list relating to the post of Junior Engineer (Mechanical) Grade-II.

8. It is brought to the notice of this Court that the petitioner was promoted to the post of Junior Engineer (Grade-I) in the year 2015.

9. Accordingly, the captioned writ petition stands dismissed. Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs.
