through the examination conducted on 31.05.2009, should be given the first preference in Selection Grade, Special Grade, Dynamic Career Progression, Promotion, Counselling, Salary and all other monetary benefits. ORDER
This Review Application has been filed to review the order passed by this Court dated 27.02.2024 in W.P.No.6377 of 2022, thereby allowed the writ petition.
2. Originally, the writ petition has been filed challenging the order passed by the second respondent, dated 12.11.2020, rejecting the request made by the petitioners seeking grant approval for the Selection Grade with effect from the date of their appointment.
3. This Court, while allowing the writ petition, directed the respondents to grant approval for the Selection/Special Grade for the petitioners with effect from their initial date of appointment as Junior Veterinary Assistant Surgeons and grant monetary benefits forthwith. It was made clear that the 6/10
petitioners are not entitled for any monetary benefits for the scale of pay granted to the post of Veterinary Assistant Surgeons from the date of their initial appointment till the date of upgradation to the post of Veterinary Assistant Surgeon.
4. The learned counsel appearing for the petitioners herein would submit that the individual, who were originally appointed in the post of Veterinary Assistant Surgeon, on the basis of Tamil Nadu Animal Husbandry Service Rule, will be deprived of seniority, if those persons who were upgraded as Veterinary Assistant Surgeon from Junior Veterinary Assistant Surgeon were granted an approval for Selection / Special Grade from their initial date of appointment as Junior Veterinary Assistant Surgeon. The petitioners in W.P.No.6377 of 2022, who were selected to the post of Junior Veterinary Assistant Surgeon, which is lower to the post of Veterinary Assistant Surgeon, had been immediately given appointment order on 15.02.2010 itself. Whereas, the petitioners herein were appointed only on 04.06.

Thus, according to them, due to administrative process, the case of the petitioners got delayed and if their grievance was not taken into consideration, they will be deprived of getting seniority, promotion and other monetary benefits.

5. It is seen that though the petitioners were granted Selection Grade or Special Grade with effect from their initial date of appointment as Junior Veterinary Assistant Surgeon, they cannot have seniority and they cannot avail seniority on the basis of granting Selection Grade or Special Grade.
