O R D E R

This Writ Petition is filed praying for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the order dated 03.03.2022 passed by the Labour Court, Kancheepuram in I.A.No.1 of 2021 in I.D.No.34 of 2019 and quash the same and direct the Labour Court, Kancheepuram to permit the petitioner to lead oral and documentary evidence on the issues other than the merits of the charges.

2. After elaborate arguments, the learned counsel appearing for the respondent fairly conceded that except the fairness of the enquiry proceedings and on merits of charges, the respondent has no objection to adduce evidence.

3. The prayer in this writ petition is also to permit the petitioner to lead oral and documentary evidence on the issue other than the merits of the charges. Therefore, in view of the above said submission, recording the said submission of the learned counsel for the respondent, this Writ

Petition is allowed and the order passed by the Labour Court in I.A.No.1 of 2021 in I.D.No.34 of 2019 is quashed. The petitioner is at liberty to adduce evidence, except the fairness of the enquiry proceedings and on merits of charges. No cost.
