Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the learned Judicial Magistrate, Ooty, The Nilgiris to take up the complaint in S.T.C.No.1117 of 2006, for arguments and dispose of the same within the stipulated time as may be fixed by this Court.

O R D E R

The petitioner has come forward with the present petition seeking for a direction to the learned Judicial Magistrate, Ooty, The Nilgiris to take up the complaint in S.T.C.No.1117 of 2006, for arguments and dispose of the same within the stipulated time as may be fixed by this Court.

2. An explanation has been received from the learned Judicial Magistrate, Udhagamandalam which states that the matter was posted as last chance to the complainant side evidence on 08.05.2015, however, it was inadvertently adjourned https://hcservices.ecourts.gov.in/hcservices/

from time and time and now posted to 03.09.2015 for complainant side evidence. But on scrutinizing the case records, it was found that the case is at the stage of argument.

3. Considering the above stated circumstances and the fact that the accused is appearing before the Court, the learned Judicial Magistrate, Udhagamandalam is directed to dispose of S.T.C.No.1117 of 2006 within a period of three months from the date of receipt of a copy of this order. Further, the petitioner is directed to co-operate for the early disposal of the matter.

4. The Criminal Original Petition is disposed of with the above direction.
