ORDER

This petition is filed to relax the condition imposed on the petitioner vide order of this Court dated 17.10.2025 in Crl.MP.No.19286 of 2025 in Crl.RC.No.2055 of 2025 that the petitioner shall appear before the trial court on every Tuesday at 10.30 a.m. until the disposal of the criminal revision and if he is not able to appear before the trial court on any day, he shall make arrangements to file an application under section 355 of BNSS, 2023 and shall appear before the trial court on any other day in lieu of the date of his absence, as directed by the trial court.

2. Heard the learned counsel for the petitioner.

Learned counsel for the petitioner submitted that this Court vide order dated 17.10.2025 in Crl.M.P.No.19286 of 2025 has granted suspension of sentence to the petitioner on condition that the petitioner shall appear before the trial court on every Tuesday at 10.30 a.m., until the disposal of the Criminal Revision. He further submitted that the petitioner is a daily wage labourer doing Coolie work and due to the abovesaid condition, he was unable to go to his job and was badly affected and have to miss half a day of his employment. He further submitted that he has been regularly complying with the condition imposed by this Court for a period of 24 weeks. Thus he prayed for relaxing

the condition No.4(d) of the order dated 17.10.2025.

4. Considering the submissions of the learned counsel for the petitioner and also taking note of the facts and circumstances of the case, this court is inclined to modify the condition No.4(d) imposed by this Court vide order dated 17.10.2025.

5. Accordingly, condition No.4(d) of the order passed by this Court in Crl.M.P.No.19286 of 2025, dated 17.10.2025 is modified to the effect that the petitioner shall appear before the trial court on the first working day of every month at 10.30 a.m., commencing from July 2026 till the disposal of the Criminal Revision Case.

6. The petition is ordered accordingly.
