ORDER

Today, when the matter taken up for hearing, the learned senior counsel for petitioner would submit that at the time of admitting the Second Appeal, this court ordered for remanding back the suit to the trial court without issuance of notice, but he is having valid objections. Now, the learned counsel for respondents appeared through their counsel. So, he filed the present petition to recall the order.

2. On perusal of records, on the date of admission of Second Appeal, this Court disposed of the same by remanding back the suit to the trial court. However, the learned senior counsel for petitioner would submit that in the Second Appeal, the petitioner is having valid case and hence, reasonable opportunity is to be given to them. Considering his submissions, this Court is inclined to allow this petition and the judgment passed by this court is recalled.
