ORDER

This writ petition has been filed for a Mandamus to direct the Respondent to pay (Rupees Eighty One Thousand Four Hundred and Ten and Fifty Paise Only) Rs.81,410.50/- to the petitioner towards surrender of Earned Leave along with interest at 6% per annum from the date due till the actual payment for which the petitioner is right fully entitled.

2. Mr.C.Gauthamaraj, learned counsel TNSTC (Coimbatore) takes notice on behalf of the respondent.

3. When the matter came up for hearing, learned Government Advocate appearing on behalf of the respondent would submit that the eligible amount will be paid to the petitioner within a reasonable time as may be fixed by this Court.

4. The learned counsel for the petitioner submits that in all the similar matters, this Court has consistently allowed the payment along with interest at the rate of 6% per annum.

5. In that view of the matter, this writ petition is disposed of on the following terms:- 1) The respondent is directed to disburse the surrender earned leave to the petitioner if he is eligible as per the Rules within a period of twelve (12) weeks from the date of receipt of a copy of this order with interest at the rate of 6% per annum from the date it became due till the date of disbursement;

2) If the amounts are not paid within a period of eight (12) weeks from the date of receipt of a copy of this order, thereafter, the same shall carry the interest at the rate of 12% per annum from the date it became due till the date of disbursement;

3) No costs.
