PRAYER: Write Petition filed under Article 226 of the Constitution of India for issuance of Writ of Habeas Corpus, directing the 3rd respondent to produce the petitioner's uncle namely Mr.P. Paulsamy, Son of late Paramanagounder, residing at Paravalavuthottam, Nathappalayam Post, Thoorampadi Village, Dharapuram Taluk, Thiruppur District from the illegal custody of the respondents 4 to 7 before this Court and set him at liberty. For Petitioner : Mr. S. Kumaradevan For Respondents: Mrs. M. Prabhavathi Additional Public Prosecutor.
O R D E R
(Order of the court was made by N.KIRUBAKARAN.J.,) The matter was heard through "Video Conferencing". 2.When the matter is called today, the detenu has been produced before this Court through Video Conferencing. It is submitted that the detenu has been admitted in rehabilitation centre as he had become alcoholic. Mr.R.Robert, who is running the rehabilitation centre in which the detenu has been admitted, has also appeared before this Court through Video Conferencing and submitted that the family members of the detenu had admitted the detenu in his centre and his son has paid the charges. 3.Further, the detenu's son-in-law is also present along with the detenu. Therefore, it is clear that the family members are taking care of the detenu and there is no illegal custody. 3.
Hence, this Petition is disposed of with a warning that the petitioner should not indulge in this kind of cases. When the family members are taking care of the detenu, the petitioner should not cause any disturbance either to the family members or to the detenu. In case if any interference is repeated, the family members of the detenu can maintain a contempt petition itself.
