Mr.Leonard Arul Joseph Selvam, Additional Public Prosecutor, Assisted by Ms.Harshana.T Order The petitioner/accused facing trial in Crime No.4 of 2026 for the offence under Section 296(b), 218 & 326(c) of BNS, had filed this quash petition.

2. The case against the petitioner is that on 09.01.2026, the defacto complainant/the Block Development Officer, Kaveripattinam lodged a complaint stating that in Thatharalli Village under Kaveripattinam Panchayat Union, "Government Paatai Poramboke" land comprised in S.No.593/2A and S.No.593/3A had been encroached upon by eight persons including Namachivayam, son of T.V.Muniraj and T.V.Venkatesan. The Tahsildar, Krishnagiri in Na.Ka.No.3080/2025/A2 dated 03.05.2024 had declared that the land was officially measured and demarcated, and instructed the encroachers to remove the encroachments without causing any damage to the property. A notice board was also erected by the Deputy Block Development Officer clearly warning that no individual should encroach upon the said Government land. Shortly thereafter, the accused using abusive words forcibly removed the notice board placed by the authorities. Based on the complaint, initially CSR.No. 169 of 2025 assigned on 10.06.2025 and thereafter, an FIR has been registered in Crime No.4 of 2026.

3. The contention of the petitioner is that the inordinate delay has not been explained. The petitioner has been claiming right over the property and the petitioner has got objection in the manner in which the land was surveyed and demarcated. Without giving intimation to the petitioner, demarcation has been done, which according to the petitioner her lands have been encroached upon.

4. Learned Additional Public Prosecutor submits that in this case, earlier CSR.No.169 of 2025 has been assigned on 10.06.2025. Thereafter, revenue records were collected and after perusal, confirmed that the petitioner had committed the offence. FIR had been registered. Now the investigation has been completed and a charge sheet has been filed before the Judicial Magistrate, Pochampalli, Krishnagiri District on 24.02.2026.

5. In view of the above, the prayer sought for in the petition becomes infructuous. Accordingly, Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. 20-04-2026 nl Index: Yes/No Speaking/Non-speaking order To
