ORDER
This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 to 3 to provide adequate police protection to enter into his property and to take possession of the property comprised in Survey No.78/1C2 to an extent of 2400 sq.ft., situated at 178, Seruvanur Village, Ramanar Nagar, Tiruvallur District.

Heard the learned counsel appearing on either side and perused the materials available on record.

It is seen from the records that the petitioner entered into an agreement for sale in respect of the subject property with the vendor's vendor of respondent's 5 and 6. However, the vendor's vendor of the respondents 5 and 6, viz., the fourth respondent herein, failed to execute the sale deed after agreeing to sell the subject property. Therefore, the petitioner filed a suit for specific
performance in O.S.No.502 of 2021 on the file of the I Additional District Court, Tiruvallur, on the strength of the sale agreement dated 03.05.2017 and the same is pending for adjudication. After entering into an agreement, the fourth respondent sold the subject property in favour of the vendor's vendor of respondents 5 and 6 and subsequently, respondents 5 and 6 purchased the property for valid sale consideration. Now, the petitioner submitted a representation seeking police protection to take possession of the subject property. Admittedly, the petitioner has already filed a suit for specific performance as against the fourth respondent in O.S.No.502 of 2021 and the same is pending for adjudication. Therefore, if at all the petitioner succeeds in the suit and a sale deed is executed in favour of the petitioner, he has to seek recovery of possession of the subject property in accordance with law. Hence, the petitioner cannot seek police protection to take possession of the property at this stage.

In view of the above, the representation submitted by the petitioner seeking police protection cannot be considered. Thus, the writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. No costs.
