ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.11.2025 for the alleged offences under Section 304(2) of B.N.S. in Cr. No.233 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 23.11.2025, while the defacto complainant was travelling on Tiruppur - Dharapuram Road, the accused persons, who were coming on their vehicle behind the defacto complainant, had committed theft of cell phone of the defacto complainant and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is under incarceration since 23.11.2025 and he is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly opposed to enlarge the petitioner on bail on the ground that the petitioner has also involved in 7 other previous cases.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The learned Government Advocate strongly opposed the bail application stating that the petitioner has 7 previous cases and he would also submit that though the stolen cell phone was recovered, the very conduct of the

petitioner involving in similar nature of offences one after another, would only make him to embolden him, if he enlarged on bail. The said contention cannot be denied. Therefore, considering the nature of allegations and upon the fact that the petitioner has been involved in so many cases, this Court is of the view that the petitioner is not entitled to any bail at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 25-03-2026 MJS Note:
