J U D G M E N T

Today, when the matter is taken up for hearing, the learned counsel for the appellant made a submission that the parties to the Appeal Suit had already settled the dispute out of the Court. Thus, no further adjudication needs to be undertaken in respect of the grounds raised in the present Appeal Suit and so he seeks permission of this Court to withdraw this Appeal Suit and he has also made an endorsement to that effect.

2. In view of the submission made by the learned counsel for the appellant and the endorsement made by him, the Appeal Suit stands dismissed as withdrawn. No costs. Consequently, the connected miscellaneous petition is also closed.
