(Cr.No.04/AC/2007) ..Respondent(s) Prayer: This petition has been filed seeking to relax the condition in Paragraph 6(iii) which reads that the petitioner shall appear before the trial court on the first working day of every month at 10.30 a.m until the disposal of the appeal and if he is not able to appear before the trial court on any day, he shall make arrangements to file an application under section 317 Cr.P.C. and shall appear before the trial court on any other day in lieu of the date of his absence, as directed by the trial court as imposed by this in Crl.M.P.No. 18594/2024 in Crl.A.No. 1673/2024 vide order dt. 27.12.2024 pending disposal of the above Criminal Appeal.

ORDER
Vide order dated 27.12.2024 made in Crl.M.P.No.18594 of 2024 in Crl.A.No.1673 of 2024, this Court had suspended the substantive sentence of imprisonment imposed on the petitioner and enlarged him on bail on certain conditions and one among such conditions is that the petitioner shall appear before the trial court on the first working day of every month at 10.30 a.m until the disposal of the appeal and if he is not able to appear before the trial court on any day, he shall make arrangements to file an application under section 317 Cr.P.C. and shall appear before the trial court on any other day in lieu of the date of his absence, as directed by the trial court. This criminal miscellaneous petition has been filed by the petitioner seeking relaxation of the aforesaid condition, on account of his serious indisposition.
2. Learned Government Advocate(Crl.Side) appearing for the respondent submitted that the petitioner has been complying with the condition imposed by this Court without any default.
3. In view of the above, this Court is inclined to modify the condition
imposed by this Court in respect of the appearance of the petitioner in the following manner.

Accordingly, the condition insofar as the petitioner's appearance as imposed by this Court at para no.6(iii) of the order dated 27.12.2024 made in Crl.M.P.No.18594 of 2024 in Crl.A.No.1673 of 2024 alone stands modified to the effect that the petitioner shall appear before the trial Court once in every four months on the first working day of the particular month, commencing from May 2026. All other conditions imposed in the order dated 27.12.2024 remain unaltered.
5. This criminal miscellaneous petition stands ordered accordingly. 24-03-2026 DN
