under Section-47(1) of the Tamil Nadu Government Servants [Conditions of Service] Act, 2016 retrospectively w.e.f. 09-09-2025 for the year 2025-26 on par with the petitioner's immediate juniors, as per Sl.No: 1 in Part-A(II) of Schedule-XI under Section 7 of Tamil Nadu Government Servants (Conditions of Service) Act, 2016 or otherwise revert the individuals as per Section-17(3) of Tamil Nadu Government Servants [Conditions of Service] Act, 2016 temporary appointed in the post of Municipal Commissioner Grade-II under Section-17(l) of Tamil Nadu Government Servants [Conditions of Service] Act, 2016 for the year 2019-20 in GO (3D) No: 11 Municipal Administration and Water Supply (ME.l) Department, dated: 10-03-2020.

This writ petition is filed for the following relief: "To direct the 1st respondent herein to issue orders with the concurrence of 2nd respondent on the petitioner's representation dated: 31-01-2026 to promote him in the vacant post of Special Grade Municipal Commissioner 2/7

temporary under Section-47(1) of the Tamil Nadu Government Servants [Conditions of Service] Act, 2016 retrospectively w.e.f. 09-09-2025 for the year 2025-26 on par with the petitioner's immediate juniors, as per Sl.No: 1 in Part-A(II) of Schedule-XI under Section 7 of Tamil Nadu Government Servants (Conditions of Service) Act, 2016 or otherwise revert the individuals as per Section-17(3) of Tamil Nadu Government Servants [Conditions of Service] Act, 2016 temporary appointed in the post of Municipal Commissioner Grade-II under Section-17(l) of Tamil Nadu Government Servants [Conditions of Service] Act, 2016 for the year 2019-20 in GO (3D) No: 11 Municipal Administration and Water Supply (ME.l) Department, dated: 10-03-2020."

2. The case of the petitioner is that in the year 1988, he joined the post of Junior Assistant in the Kadayanallur Municipality on compassionate ground. In the year 2000, he was promoted as an Assistant in the office of the Director of Municipal Administration. 3/7

Thereafter, in the year 2015 the petitioner was promoted as a Superintendent.

3. The petitioner would submit that he is eligible to be promoted as Municipal Commissioner Grade II on completion of 5 years service as Superintendent. However, the respondents appointed the petitioner's junior as a Municipal Commissioner Grade II, without following the Special Rules for Tamil Nadu Municipal Commissioner Sub Ordinate Services. Therefore, in this regard the petitioner made a representation dated 31.01.2026 to the respondents. Since there is no response to the said representation, the petitioner is before this Court.

4. Considering the facts and circumstances of the case and the fact that the petitioner's representation dated 31.01.2026 has not been considered to date, the 1st respondent is directed to consider the representation and pass orders on merits and in accordance with law, within a period of 2 months from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
