The present criminal original petition has been filed to transfer the investigation in Crime No.310 of 2015 on the file of the Inspector of Police, Melmaruvathur Police Station to any other investigating agency such as CBCID, Cuddalore or any other Agency.
2. The petitioner's son namely, A.Naveenkumar was studying in Melmaruvathur Athiparasakthi Engineering College, Melmaruvathur in Mechanical Engineering Department in the year 2011-2012. He was inmate in the hostel attached to the college. He lastly stayed in Room No.226 in the second floor of the hostel building. On 02.07.2015 at about 7.00 a.m. the petitioner received a phone call from the Hostel Warden that his son had committed suicide by hanging. The petitioner herein lodged complaint as against the college authorities and the same was registered on 02.07.2015 under Section 174 Cr.P.C., in Crime No.310 of 2015. Since no action was taken thereafter, the petitioner has come forward with the present petition to transfer the case to some other investigation agency.
3. The learned Additional Public Prosecutor submitted that the investigation is in progress and during the course of investigation, the suicide note was sent to Forensic Department for verifying the signature and writing of the deceased, but the same was returned by the Forensic Department stating that no previous document containing hand writting of the deceased was sent for comparison that is the reason why there is a delay in completing the investigation, hence there is no need to transfer the investigation.
4. Considering the submissions on either side, the petitioner is directed to produce any previous writing, which contains the handwriting of the deceased to the police to enable them to send the suicide note to the Forensic Department so that the respondent police could complete the investigation.
5. This criminal original petition is disposed of accordingly. Consequently connected miscellaneous petition is closed.
