Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to Writ of Certiorarified mandamus calling for the records pertaining to the respondent's letter No.545A/2014-15/ TNSCST/ Court-GJ/RJ951 dated 19.1.2015 and quash the same and consequently direct the respondent to implement the revised Pay Scale in the Post of Driver to the petitioner in the Selection Grade at Rs.9,300-34,800 + Grade Pay of Rs.4,400 with notional effect from 1.1.2006 with monetary benefit from 1.1.2007 as per G.O.Ms.No.65 Finance dated 26.02.2011 read with Government letter No.14173/Paycell/2011-1 dated 14.3.2011 with all consequence

benefits.

ORDER

This writ petition has been filed to call for the records pertaining to the respondent's letter No.545A/2014-15/ TNSCST/ Court-GJ/RJ951 dated 19.1.2015 and quash the same and consequently direct the respondent to implement the revised Pay Scale in the Post of Driver to the petitioner in the Selection Grade at Rs.9,300-34,800 + Grade Pay of Rs.4,400 with notional effect from 1.1.2006 with monetary benefit from 1.1.2007 as per G.O.Ms.No.65 Finance dated 26.02.2011 read with Government letter No.14173/Paycell/2011-1 dated 14.3.2011 with all consequence benefits.

There is no representation for the petitioner on the last two occasions. When the matter was taken up for hearing today, the

learned counsel for the respondent would submit that the petitioner has been paid the entire Grade Pay arrears totaling a sum of Rs.2,60,445/- and he has also submitted the documents to this effect. He would further submit that since the entire amount has been paid, nothing survives for the consideration and therefore, this matter has become infructuous.

Recording the same, this Writ petition is dismissed as infructuous. No costs.
