ORDER
The petitioner/accused, who apprehends arrest pursuant to an Non Bailable Warrant issued by the learned XVIII Additional Judge, Chennai on 28.02.2025, seeks anticipatory bail.

The petitioner was enlarged on bail in a murder case and during the investigation, he did not appear before the trial Court and hence, NBW was issued on 28.02.2025.

The learned counsel for the petitioner would submit that the petitioner was released on bail and the case is pending in S.C.No.322 of 2022; that he did not appear before the trial Court for investigation and hence, NBW was issued and thereafter, NBW was recalled on 21.01.2025 with a condition that the petitioner shall report before the trial Court daily morning at 10:30 a.m, and in the evening at 5:00 p.m. But due to his health conditions, the petitioner
was unable to report before the trial Court and hence, NBW was issued on 28.02.2025, by the learned XVIII Additional Judge, Chennai. 4.
The learned Government Advocate (Crl.Side),reiterated the prosecution case and submitted that though summon was served on the petitioner, he did not appear before the trial Court. 5.
Heard both sides.

Considering the rival submissions, this Court is of the view that the anticipatory bail cannot be granted. However, the petitioner is at liberty to approach the learned trial Judge, for recall of warrant, which shall be considered by the learned Judge on merits and in accordance with the law.
