O R D E R
The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the 2nd respondent to dispose of the Appeal dated 12.02.2010 preferred by the petitioner to cancel the patta issued in favour of the respondents 5 to 35 in respect of the land comprised in S. No.38/1B measuring about 1.35 acres of land bearing Patta No.215 of land situated at Nonanganur Village, Pattukonampatti Panchyat, Pappireddipatti taluk, Dharmapuri District.
2. Mr. A. Nagarathinam, learned counsel appearing for the petitioner submitted that though the petitioner has filed the Appeal before the 2nd respondent as early as on 12.02.2010, the 2nd respondent has not disposed of the same yet.
3. Mrs. K.Bhuvaneswari, learned Additional Government Pleader, appearing for the respondents 1 to 4, submitted that the 2nd respondent may be directed to dispose of the Appeal dated 12.02.2010 in accordance with law, after giving notice to all the interested parties.
4. Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the learned counsel for the petitioner, without expressing any opinion with regard to the merits of the
case, I direct the 2nd respondent to dispose of the petitioner's Appeal dated 12.02.2010, on merits and in accordance with law, after giving notice to all the interested parties, within a period of twelve weeks from the date of receipt of a copy of this order.
With these observations, the Writ Petition is disposed of. No costs.
