ORDER

This Writ Petition has been filed seeking a direction to the third respondent to consider the petitioner's representation dated 28.05.2025.

2. Heard the learned counsel appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. It is the case of the petitioner that the petitioner's parental great grand father A.Thangavel Naickar died on 15.04.1948 which was registered with the Tahsildar in the year 1948 and subsequently, she obtained the death certificate of the said A.Thangavel Naickar on 22.12.2020, wherein the deceased father's name Vedagiri Naickar was omitted. Due to which, she made a representation to the Tahsildar along with conclusive documentary evidence on 28.05.2025, however, there was inaction on the part of the respondent and hence, the present Writ Petition.

4. The learned counsel for the petitioner submitted that it would be suffice to issue a direction to the respondent to consider the petitioner's representation dated 28.05.2025 and to pass appropriate orders, within a reasonable time.

On perusal of the records show that the death of the deceased A.Thangavel Naicker was in the year 1948 and after lapse of several years i.e., nearly 75 years, the petitioner has approached the respondent for inclusion of the deceased father's name in the death certificate which is impermissible, since the Registration of Births and Deaths Act came into force only in the year 1969.

This Court is of the opinion that the subject issue has to be adjudicated only before the competent Civil Court and therefore, the present petition is liable to be dismissed.

6. In view of the above, the Writ Petition stands dismissed. There shall be no order as to costs.
