(Order of the Court was made by DR.S.VIMALA,J.,) This petition has been filed by one Perumal alleging that his son, who was engaged in road work along with them, was found missing and in respect of which, a case has been registered under the head of "boy missing" in Crime No. 40 of 2018 on the file of F-5, Choolaimedu Police Station, Chennai. Praying that the respondent must be directed to trace out the detenu, this petition has been filed.
2.The respondent has filed a status report stating that the detenue was done to death by four accused persons and this fact has also been intimated to the parents of the detenu and thereafter, the case has also been altered from "boy missing" to Sections 302 and 201 I.P.C. https://hcservices.ecourts.gov.in/hcservices/
3.It is also submitted that after exhumation, the parents identified the body as that of their son / detenu Rajesh and based on the identification of the dead body, a death certificate was also issued by the Tahsildar concerned.
4.Under such circumstances, nothing survives for further adjudication in this petition. Therefore, this Habeas Corpus Petiton is closed.
