Suppressing the fact of employment, the workman, namely, R. Pachaiappan, had filed an affidavit before this Court. 2.

According to the Management, the said workman was gainfully employed, which fact was not brought to the notice of this Court and therefore, he has committed perjury and he needs to be prosecuted. 3.

Though the Court is empowered to take cognizance of the provisions of Section 191 of the Indian Penal Code read with Sections 195 and 340 of the Code of Criminal Procedure and punish the workman for perjury, since he has filed an affidavit, tendering unconditional apology, stating that he made the averment inadvertently, and that there was no fraudulent intention, we accept the apology, with a warning to him to be careful in making such incorrect statements, in future. deposited in his name, the Management/employer is permitted to withdraw the said amount together with accrued interest. 4.
