The petitioner, who is the injured claimant / respondent in the appeal seeks withdrawal of the amount deposited by the Insurance Company pursuant to the interim order dated 16.10.2023. It is claimed that the petitioner was rendered a paraplegic, having incurred 90% disability in the accident and therefore, she needs money for her treatment.

2. Considering the totality of the circumstance and the fact that only 50% of the amount has been directed to be deposited, we are of the opinion that the petitioner can be permitted to withdraw the said amount without furnishing security. This petition is therefore, allowed, the petitioner is permitted to withdraw the entire amount deposited by the Insurance Company.
