This Criminal Original Petition has been filed to direct the respondents to give protection to the petitioner's hospital, Viz., M/s. Vasan Eye Care Hospital, situated at No.5-M, III Avenue, Anna Nagar East, Chennai - 600 102.
2. The learned counsel for the petitioner would submit that the respondent is continuously interfering the possession and enjoyment of the petitioner and he causing threat to the petitioner and therefore, the petitioner gave a complaint to the https://hcservices.ecourts.gov.in/hcservices/
respondent police seeking for police protection. Since the same was not considered, this petition has been filed seeking for appropriate direction.
3. It is seen from the records that there is dispute between the landlord and the tenant. The petitioner has already filed a suit in O.S.No.928 of 2019 before the XII Assistant Judge, City Civil Court, Chennai. In the said suit, the petitioner has filed I.A.No.1 of 2019, seeking for interim injunction restraining the defendant from interfering the peaceful possession and enjoyment of the suit property. The Court below has also granted an order of injunction in favour of the petitioner.
4. Considering the facts and circumstances of the case, the 2nd respondent is directed to conduct an enquiry on petitioner's complaint dated 29.03.2019 with the counter part after giving opportunities and pass orders on merits in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
5. The criminal original petition is disposed of with the above direction.
