The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under sections 120(B), 406, 420 of IPC and 5 of the TNPID Act 1997 in Crime No.02 of 2022 seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused received a sum of Rs.7,70,000/- from the defacto complainant to invest in UNIVER COIN crypto currency and cheated him. Hence, the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) for the respondent police submitted that the petitioner along with other accused received a sum of Rs.7,70,000/- from the defacto complainant to invest in UNIVER COIN crypto currency and cheated him. He further submitted that the investigation is at crucial stage, if petitioner is granted anticipatory bail at this juncture, then there will be possibility of abscondence, tampering of witnesses and hampering of investigation. He further submit that this Court had already dismissed the anticipatory bail application of the petitioner in Crl.O.P.No.25210 of 2022 vide order dated 04.01.2023.Hence, he opposed to grant anticipatory bail to the petitioners.

5. Heard the learned counsel for the petitioner and the learned Government Advocte (Criminal Side) appearing for the respondent police and perused the materials available on records.

Considering the facts and circumstances of the case and also the fact that this Court had already dismissed the anticipatory bail application of the petitioner in Crl.O.P.No.25210 of 2022 vide order dated 04.01.2023 and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this criminal original petition is dismissed.
