PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus, directing the respondents to consider petitioner's representation dated 23.03.2023 and also necessary to direct the respondents 1 to 5 not to disburse the retirement benefits and pension benefits to the 6th respondent.

ORDER
This writ petition is filed for a mandamus directing the respondents 1 to 5 to consider the representation of the petitioer dated 23.03.2023 and to direct the respondents 1 to 5 not to disburse the retirement benefits and pension benefits to the 6th respondent.
2. The grievance of the writ petitioner is that the 6th respondent is her husband and when the petitioner, who is the legally wedded wife is there, the 6th respondent developed some illicit relationship with a third party and has tried to nominate her name in the service records.
3. When the 6th respondent is alive, he is the only person entitled to receive his retiral benefits. The question as to who is the legally wedded wife would not arise at all. The petitioner has obtained orders of 2/4
maintenance. It is open to her to approach the appropriate Court executing the order by obtaining orders of attachment.
4. In view thereof, at this juncture , the direction as such sought for cannot be granted and accordingly, it is open to the petitioner to raise all contentions before the appropriate proceedings.
