The learned Additional Public Prosecutor takes notice for the respondent.

This Court, on going through the averments made in the affidavit filed in support of the petition to condone the delay and upon hearing the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent, is convinced with the reasons given for the delay and accordingly the delay is condoned.

3. Hence, this petition is allowed.
