ORDER

This petition has been filed to condone the delay of 444 days in filing the Second Appeal.

2. The learned counsel for the petitioner submits that the petitioner is aged about 60 years and illiterate. In stead of filing appeal she filed review petition and thereafter filed the present appeal and also due to lack of communication between the petitioner and his lower Court counsel, the petitioner was not able to file the appeal on time. Hence, he prays to allow this petition.

3. Considering the fact that the petitioner is aged is aged about 60 years and illiterate, the reason assigned by the petitioner is satisfactory. Accordingly, this petition is allowed. Registry is directed to number the Second Appeal if it is otherwise found to be in order and post the matter on 03.04.2025.
