ORDER

The petitioner had given a complaint on 03.01.2025 before the respondent police against one Sabari and Pavunraj. However, since the respondent police did not issue a CSR and had not taken up further investigation on the complaint given by the petitioner, the petitioner filed a petition under Section 175(3) of BNSS. 2023 before the trial Court/Judicial Magistrate Court No.II, Gobichettipalayam in Crl.M.P.No.73 of 2025 seeking for a direction to the respondent police to register an FIR on the complaint given by the petitioner. The trial Court by order dated 31.10.2025 had allowed the said petition directing the respondent police to register an FIR on the complaint of the petitioner. However, till date no FIR has been filed. Hence, the petitioner is before this Court with this petition.

2.Today, when the matter was called for hearing, the learned Additional Public Prosecutor produced the FIR copy registered by the respondent police on the complaint given by the petitioner in Crime No.60 of 2026 as per the directions of the Judicial Magistrate No.II, Gobichettipalayam. Hence, the FIR has been registered on the complaint given by the petitioner. 3.With regard to the second prayer sought by the petitioner, to direct the respondent police to file the final report before this Court, the same cannot be

entertained since, it is stipulated under the BNS Act, how a final report/charge sheet has to be filed. Hence, the petition is dismissed as regards the second prayer sought by the petitioner.
