By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.
2. This writ petition has been filed seeking to issue a Writ of Mandamus, directing the first respondent to dispose the petitioner's representation dated 25.01.2022.
3. The case of the petitioner in brief:
The petitioner is working as Salesman in the respondent corporation and he is a graduate in B.Com Degree. The first respondent issued a circular No.RV-2/7879/2007 dated 21.09.2007 to all the District Manager of TASMAC to recommend for promotion to the post of Supervisor on attaining the experience of more than ten years and the educational qualification for the above post is a bachelor of Degree in any one of the recognised university. Being a Graduate Degree holder, the petitioner is eligible for the post of Supervisor, however, he was not selected to that post, whereas, one E.Selvakumar, who was served as Salesman, like petitioner, was appointed to the said post. Therefore, the petitioner made several representations to the first respondent seeking promotion to the post of Supervisor in any one of the shops running under the respondent corporation and last such representation is dated 25.01.2022. The said representation is still pending and no order has been passed. Hence, the petitioner filed this instant writ petition before this Court.
4. Mr.K.Sathish Kumar, learned Standing Counsel takes notice for the respondents submitted that the representation of the petitioner will be considered by the authorities concerned and appropriate orders will be passed on merits and in accordance with law.
5. Inview of the above submissions and also considering the limited scope of prayer, without expressing any opinion on merits, the following order is passed.
i) The first respondent is directed to consider the representation of the petitioner dated 25.01.2022 and to pass orders on its own merits and in accordance with law, as early as possible, within a period of eight weeks from the date of receipt of a copy of this order.
ii) The petitioner is directed to produce the copy of the above representation along with this order before the first respondent.
6. With the above direction, the writ petition stands disposed of. No costs.
