The Criminal Original Petition has been filed to direct the respondent to register a case on the complaint dated 28.06.2016, given by the petitioner.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3. It is seen that on the complaint dated 28.06.2016, given by the petitioner, petition enquiry is pending in CSR.No.56 of 2016.
The learned Additional Public Prosecutor submits that the petitioner is not co-operating with the enquiry.
4. Recording the submission of the learned Additional Public Prosecutor, the petitioner is directed to cooperate with the enquiry and the respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision https://hcservices.ecourts.gov.in/hcservices/
laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.
With the above direction, this Criminal Original Petition is closed.
