ORDER : The Court Made the following order :- The petitioners, seek Anticipatory bail for the alleged offence under Section 294(b), 324, 506(ii) IPC @ 147, 148, 294(b), 324 and 307 IPC in Crime No.1145 of 2017.
2. Heard both sides.
3. Totally there are 5 accused in this case and the petitioners is A1 and A2. The case of the prosecution is that while bursting crackers, there occurred a quarrel between the defacto-complainant and the accused persons and at that time, these petitioners along with other accused, attacked the defacto complainant with iron rod.
4. The learned counsel for the petitioner would submit that this is a case in counter and on the date of occurrence, the family members of the defacto complainant attacked the first petitioner and for the same, a complainant has also been filed against them.
5. The learned Government Advocate (Crl. Side) submitted that this is a case in counter and the injured was discharged from the hospital.
6. Having regard to the fact that the injured has already been discharged from the hospital and the petitioners have no bad antecedent and it is not stated that petitioners' custodial interrogation is necessary, I am inclined to grant anticipatory bail to the petitioner, subject to the following conditions. 7 (i) Petitioners are ordered to be released on bail in the event of their arrest or appearance before the learned Judicial Magistrate No.1, Tiruvannamalai, within a period of fifteen days days from the date of receipt of a copy of this order on each ofthem executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate.
(ii) the petitioner shall report before the respondent police daily at 10.30 a.m for a period of two weeks and thereafter, as and when required for interrogation.
