Respondents Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of mandamus directing the respondents 1 to 5 to disburse the entire monetary benefits of Pension and settlements of the 1st petitioner's deceased husband Mr. C.Pauldass (No.8705) to the 6th respondent.
For Petitioners : Mr. A.Manojkumar For Respondents 1-5 : Mr. C.Kathiravan Government Advocate : No appearance O R D E R This writ petition is filed to issue a Writ of mandamus directing the respondents 1 to 5 to disburse the entire monetary benefits of Pension and settlements of the 1st petitioner's deceased husband to the 6th respondent.
2. The petitioners are the wife and son of the deceased Pauldass who was a Police Constable. It is stated by the petitioners that the deceased Pauldass married the sixth respondent with the consent of first wife, the first petitioner herein, to take care of her son. It is further stated that the petitioners have no objection to disburse the monetary benefits of deceased Pauldass to the sixth respondent. The petitioners have also submitted a letter and affidavit to the respondents so that the sixth respondent could avail the retirement benefits of her husband such as pension and other dues which are payable upon the death of deceased Pauldass. A representation was also submitted by the petitioner on 12.01.2021 to the respondents. Since no amount was disbursed to the sixth respondent, the petitioners have approached this Court by filing this writ petition.
3. Learned counsel appearing for the petitioner submitted that the petitioners will be satisfied if a direction is issued to the second respondent to consider and dispose of the representation of the petitioners dated 12.01.2021, within a time stipulated by this Court.
4. Having regard to the limited scope of the prayer that is now sought by the petitioner's counsel, without expressing any opinion on the merits of the petitioner's representation, this Court directs the second respondent to consider the petitioner's representation dated 12.01.2021, and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
