Seeking leave to sue the respondents, the applicant/plaintiff has come up with this application.
2. The learned counsel for the applicant would submit that the suit has been instituted for partition and for separate possession of the suit properties and also for declaration to declare the settlement deeds as null and void. It is further submitted that out of 22 items of scheduled properties, five items alone are situated outside the jurisdiction of this court and therefore, cause of action has arisen within the jurisdiction of this Court.
3. Considering the submission made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
