ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326(a) of BNS and 21(1) of Mines and Minerals (Development and

Regulation) Act, 1957 in Crime No.459 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The allegations against the petitioner is that the petitioner along with other accused was found in illegal transportation of two units of sand. Hence, the case.

3. Learned counsel for the petitioner submitted that this is the third anticipatory bail petition. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that the petitioner has one previous case, similar in nature pending against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Here, the petitioner has one previous case of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
