ORDER

The petitioner apprehends arrest for the alleged offence under Sections 296(b), 115(2), 118(1) and 351(3) of Bharatiya Nyaya Sanhita (BNS) in Crime No.555 of 2025 on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that the defacto complainant Priyanga, who is the wife of the petitioner lodged a complaint stating that due to matrimonial dispute on 18.12.2025 at about 10.00 p.m., the petitioner picked up a quarrel with her, assaulted her using a deadly weapon, caused injuries, abused her in filthy language and threatened her with dire consequences. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged. It is submitted that the defacto complainant is the wife of the petitioner and due to matrimonial discord, a false complaint has been lodged. It is also submitted that the petitioner is ready to cooperate with the investigation and abide by any condition imposed by this Court. Hence, he prayed for granting anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner assaulted his wife using a deadly weapon, causing injuries and also threatened her. It is further submitted that the nature of allegations is serious and involves domestic violence with use of weapon. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the submission of the learned counsel on either side, though it is contended that the complaint arises out of matrimonial dispute, the allegation against the petitioner is that he assaulted his wife using a deadly weapon and caused injuries. Considering the nature of allegations and the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
