ORDER

The petitioners apprehend arrest for the alleged offence under Section 420 of IPC, in Crime No.113 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant was deceived by the petitioners on the promise to sell certain land. However, the petitioners did not have title over the said property and thereby cheated the defacto complainant to the tune of Rs.5 lakhs. It is further stated that a sum of Rs.1.5 lakhs has been returned by the petitioners. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. He further submitted that the petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side), appearing for the respondent police, submitted that the petitioners have one previous case of a similar nature in Crime No.640 of 2025 on the file of Soolamangalam Police

Station. Hence, he opposed the grant of anticipatory bail to the petitioners.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. From the submissions of the learned Government Advocate (Crl. Side), it is seen that the petitioners are involved in a previous case of a similar nature, which indicates that they have misused the liberty granted earlier and are indulging in similar activities repeatedly. Hence, this Court is of the view that the petitioners do not deserve the grant of anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
