ORDER

This Writ Petition has been filed seeking for a Writ of Mandamus, to direct the respondents 3 to 6 to dispose the petitioner's representation to disconnect the Permanent Service Connection No. 567-008-521 provided in the petitioner's legally inherited property located at the survey No 234/1C.

2.The case of the petitioner is that the petitioner is the absolute owner of the property ad-measuring to an extent of 8 cents out of 31 cents in Sy.No.234/1C inherited from his grandfather one Mr.Duraisamy Naicker through Deed of Settlement dated 13.04.2016 executed by his father D.Venkatesan, which was registered in document bearing no.3899/2016 at

Joint II SRO, Chengalpattu. While so, the 7 th and 8 th respondents herein have unlawfully and illegally entered and occupied the said property and have put up a temporary thatched shed and have also parked their JCB vehicle without any right. The 7 th and 8 th respondent have also submitted fabricated documents and obtained Permanent Service Connection No.567008-521 in the said property. 3.When the petitioner came to know about the same, he approached the 6 th respondent and gave his initial complaint and thereafter, issued a legal notice to the 6 th respondent on 24.01.2021 for disconnecting the electricity service connection provided to the respondents 7 and 8. However, no action has been taken by the sixth respondent till now. Thereafter, the petitioner had also lodged a complaint against the respondents 7 and 8 before the Inspector of Police, Maraimalai Nagar Police Station on 22.01.2023 and a FIR came to be registered in Crime No.34 of 2023 dated 22.01.2023 under the Sections 294(b), 447 & 506(1)

of IPC. Thereafter, the petitioner has given a representation dated 19.06.2023 to the respondents 3 to 6 seeking to disconnect the Permanent Service Connection No.567-008-521 provided at Survey No.234/1C belonging to the petitioner. However, the same is yet to be considered. Hence, the present Writ Petition.

4.The learned counsel for the petitioner would submit that a direction be issued to the respondents 3 to 6 to consider the representation of the petitioner dated 19.06.2023, seeking to disconnect the Permanent Service Connection No.567-008-521 within a time frame as fixed by this Court.

5.The learned Standing Counsel,TANGEDCO appearing on behalf of the the respondents 3 to 6 would submit that the representation of the petitioner would be considered within a time frame as fixed by this Court.

6.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents 1 to 3 and the learned Standing Counsel, TANGEDCO for the respondents 3 to 6 and perused the materials available on record.

7.Since no adverse order is passed against the respondents 7 and 8, notice to the respondents 7 and 8 is dispensed with. 8.Considering the facts and circumstances of the case, the respondents 3 to 6 are now directed to consider the representation of the petitioner dated 19.06.2023 and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner and also the respondents 7 and 8.
