Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to approve and permit the petitioner college to fill up the sanctioned posts of 11 non-teaching staffs viz. Sweeper- 6 Watchman-2 Gardener-1 Waterman-1 and Marker -1 in the sanctioned vacancies in petitioners college in the light of the order of this Honble court made in W.P. (MD) No. 1234 of 2014 dated 24.02.2015 in W.A. (MD) No. 931 of 2018 dated 12.07.2018 which has been confirmed the Honble Apex court in SLP No. 323 of 2019 dated 18.01.2019 by considering the proposal / Representation given by the petitioner college dated 9.12.2021 and to approve the said appointments.

O R D E R

According to the petitioner, the petitioner College submitted a proposal to the Government for approval appointment to the post Non-Teaching Staff viz., Sweeper - 6, Watchman - 2, Gardener - 1, Waterman - 1 and Games Marker - 1 due to the vacancies arose for the said posts in the College and the particulars also furnished to the Regional Joint Director of Collegiate Education, second respondent herein. According to the petitioner, the aforesaid posts are sanctioned posts. The second respondent forwarded the said proposal to the first respondent for approval to fill up the said posts. However, no order has been passed on the said proposal. Therefore, the petitioner College has preferred the present writ petition before this Court.

2. According to the learned Additional Government Pleader appearing for the respondents on instructions submitted that the proposal is pending with the first respondent for consideration and the orders will be passed in accordance with Rules.

3. Considering the limited scope of prayer sought for by the petitioner, this Court is inclined to direct the respondents to consider the proposal submitted by the petitioner College dated 9.12.2021 and pass appropriate orders on its own merit and in accordance with law, as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of copy of this order.

4. Accordingly, the writ petition stands disposed of with the above directions. No Costs.
