Application No.3510 of 2019 in C.S.No.812 of 2018 KRISHNAN RAMASAMY, J., This Application is filed for condoning the delay of 74 days in filing the Written Statement of the defendants 1 to 3 & 5 in the above suit.

2. The learned counsel appearing for the first respondent submitted that he has not filed any counter affidavit since the respondents have no objection to the Application being allowed.

3. The learned counsel appearing for the applicants/defendant Nos.1 to 3 & 5 prayed that the Application may be allowed on merits.

4. Though the reasons stated in the affidavit filed in support of the Application are satisfactory, however, taking note of the fact that the delay is of 74 days in filing the Written Statement, this Court feels that the delay has to be condoned on terms. Accordingly, this Application is allowed on payment of cost of Rs.10,000/- (Rupees Ten Thousand only) by the Applicants to the respondents on or before 26.06.2019. 07.06.2019 mrr http://www.judis.nic.in
