2. Mr.D.Suriyanarayanan, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal.
3. The petitioner seeks for a mandamus to direct the respondents to consider the representation of the petitioner dated 13.03.2020 within the time frame fixed by this Court.
4. The grievance of the petitioner is that the respondents are trying to put up a construction in his private property without following any due process of law under the guise of constructing a fair price shop.
5. Learned Additional Government Pleader appearing for the respondents on the other hand, contended that the property, in which the said shop is being constructed, is a government property.
6. This Court, at this stage, is not expressing any view on the rival claim made by the parties, as this Court is inclined to dispose of the writ petition by directing the respondents 1 to 4 to consider the representation of the petitioner dated 13.03.2020 and pass orders on the same, after giving due opportunity of hearing to the petitioner and other interested parties, if any. Such exercise shall be done by the respondents 1 to 4 within a period of four weeks from the date of receipt of a copy of this order. Till such time, if any construction activities is going on, the same shall not be proceeded further until an order is passed on the petitioner's representation. The writ petition is disposed of accordingly. No costs. The connected miscellaneous petition is closed.
