This Civil Miscellaneous Petition has been filed seeking to accept the cause title in the above second appeal by amending the name of appellant from M/s.Forech India Private Limited as shown in the present Memorandum of Second Appeal.

2. Mr.AR. Ramanathan, learned counsel for petitioner submitted that the change of name of appellant company from 'Limited' to 'Private Limited' though has occurred on 19th February 2016, inadvertently, it was not noticed during the pendency of suit as well as First Appeal and the same was noticed only at the time of filing this Second Appeal. He would further submit that there is no change in the main name and also there is no change in the constitution of appellant. Hence, it is just and necessary to file the present petition praying to accept the cause title by amending the name of appellant.

3. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit as justifiable one, this petition is allowed for amending the name of appellant from M/s. Forech India Limited to "M/s. Forech India Private Limited". Registry is directed to number the second appeal if it is otherwise found to be in order and post the matter on 12.06.2024.
